Our goal at KWMedia is your complete delight with our experience together, and we are SO EXCITED about the possibility of catching some magic with you! Basically, all this legal mumbo jumbo below is to make sure everybody gets a fair shake. BOOKING

For all personal and family sessions, a $200 non-refundable session retainer is required to book and reserve the photographers time. Wedding, event and travel photography services are subject to a deposit retainer equivalent to 25% of the total package cost. This fee serves as cancellation fee should the client be unable to attend the session or reschedule an alternative shooting time. The remaining balance is due on the session date. Retainer fee MUST be paid at time of booking.

PAYMENT

All retainer fees must be paid at time of booking; acceptable forms of payment include Venmo, PayPal, cash and (in some cases) personal check. Booking is not finalized until KWMedia Photography receives payment. If paying by check, the client is responsible for an additional charge of $35 in the event of an uncleared check.

CANCELLATION POLICY

In the event of a client-generated cancellation, the session retainer will act as cancellation fee. The fee can be credited towards a future session if the client reschedules the appointment by contacting KWMedia Photography at least 72 hours prior to the date of session and re-booking at an agreeable date and time. If KWMedia Photography cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to photographer’s illness or emergency, then the photographer shall return the retainer fee to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or other media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. In the event KWMedia Photography fails to perform for any other reason, KWMedia Photography shall not be liable for any monetary amount in excess of all monies paid.

TIME

Please be on time and considerate of the photographer’s time. Client agrees and understands that the start time agreed upon is the time the session begins. If clients are late for any reason, this time is deducted from their session (client loses this time). If the client is more than 20 minutes late with no communication with the site photographer, said photographer is under no obligation to wait and said client forfeits the booking fee. If the client wants to reschedule after the photographer has left, an additional booking fee must be paid under a new booking appointment. If KWMedia Photography is late for any reason, the photographer will immediately contact the client to communicate status of arrival. Any lost time will be added to the session. If clients are unable to wait, KWMedia Photography will either refund the booking retainer or reschedule the session.

*NOTE* - Photographer works around natural lighting. Outdoor shoots are typically scheduled one hour before sunset or within an hour after sunrise. Indoor shoots are typically done in the morning when lighting is the softest. Please be mindful of this when booking a session.

ADDITIONAL TIME

If the client requests added time or services (i.e., the addition of models, locations, wardrobe changes, etc.), supplemental fees will be incurred at the discretion of KWMedia Photography. Said fees shall be disclosed to the client at the time of incurrance. Client requested supplemental shooting time shall be incurred at a rate of $50 per 15 minutes that the session runs over. WEATHER The photographer has full discretion as to move forward or reschedule a photoshoot due to weather. If rescheduling due to weather, the booking retainer will move to the new date. In the event of rain, KWMedia Photography reserves the right to cancel the session. If client decides to move forward to photographing on a cloudy day against KWMedia Photography’s judgment and does not like the outcome of the photos, client may not collect the booking retainer and KWMedia Photography has no obligation to repeat the session. A new session fee and retainer must be collected.  

MODEL RELEASE

KWMedia Photography has the absolute and irrevocable right and unrestricted permission concerning any photographs that they have taken or may take of the client or in which the client may be included with others, to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use the client name in connection with any use if he/she so chooses. The client releases KWMedia Photography from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This release shall be binding upon client and their heirs, legal representatives, and assigns.

TURNAROUND TIME

Unless previously and clearly stated by the KWMedia Photography, family and personal session proofs will be delivered to the client 1-2 weeks after the conclusion of the shooting session. For travel and wedding photography, delivery time line will be clearly stated and agreed upon prior to booking, based on date, travel schedule and the discretion of KWMedia Photography and their photographers. Rush orders can be placed with a turnaround time of less than one week for an additional $100 in some cases.
